This Letter of Engagement sets out the basis upon which an instruction submitted through the Caledonia Risk Engagement Form is accepted and undertaken.
This Letter of Engagement applies to the instruction submitted by the Client through the Caledonia Risk Engagement Form.
The information, instructions and supporting material submitted through the Engagement Form form the basis of the Client’s instruction to Caledonia Risk.
The service will be undertaken subject to acceptance by Caledonia Risk and in accordance with the applicable Caledonia Risk Terms of Business.
The Client agrees to the professional fee, rate or charging basis communicated by Caledonia Risk in connection with the instruction.
This may be communicated by quotation, email, telephone, invoice or other agreed communication.
Where a fixed fee has been quoted, that fee applies to the agreed scope of work.
Where services are charged by time, deployment period, operative, specialist, search, attempt or another agreed basis, charges will be calculated in accordance with the rate communicated to the Client.
Additional work requested or authorised outside the original instruction may incur additional charges.
Unless expressly stated as included within the agreed fee, reasonable expenses necessarily incurred in carrying out the instruction will be charged in addition to professional fees in accordance with the Caledonia Risk Terms of Business.
Where a specific expense rate or charging basis has been communicated to the Client, that rate or basis will apply.
By selecting the acceptance checkbox and submitting the Engagement Form, the Client confirms that:
The information submitted through the Engagement Form is accurate and complete to the best of their knowledge;
They have authority and a lawful purpose to issue the instruction;
They accept the fee, rate or charging basis communicated by Caledonia Risk;
They accept responsibility for applicable expenses in accordance with this Letter of Engagement and the Caledonia Risk Terms of Business;
They have read and agree to this Letter of Engagement and the Caledonia Risk Terms of Business; and
They acknowledge the Caledonia Risk Privacy Policy.
The submitted Engagement Form and associated electronic acceptance record may be retained by Caledonia Risk as evidence of the Client’s instruction and acceptance.
